Information Collected
SeeHearSpeakUp Ltd, pursuant to an agreement with its clients, provides a website to collect from employees wishing to report information. This information includes but is not limited to allegations of misconduct, questionable business practices, violations of the company's code of conduct or other events and behaviour which may result in harm, injury or liability. The information collected and submitted is forwarded, without review or modification by SeeHearSpeakUp, to the client's authorised receivers of information.
Unless you request otherwise, all data provided by you, including your name and contact details, will be passed to the senior management within your employer.
Under the General Data Protection Regulations, SeeHearSpeakUp act as the data processor and your employer acts as the data controller. Where you have not provided your consent to share your personal details with your employer, we shall be regarded as the controller in respect of your personal data.
Accuracy of Information
SeeHearSpeakUp does not vouch for, nor authenticate the reliability of information collected. SeeHearSpeakUp is not responsible for investigating or resolving the issues or concerns provided in a report. The client for which the information has been collected has the sole responsibility to evaluate the information and to comply with all local laws pertaining to the investigation and protection of such information, as well as the protection of all rights of any person or persons accused of any wrongdoing. Submitting false or misleading information may lead to criminal and civil prosecution.
Anonymity
If you wish for SeeHearSpeakUp and/or your company to contact you directly, you may provide your name and other contact information. To protect your anonymity, please be careful not to include personally-identifying information. However, although you elect to remain anonymous, your identity may become known during an investigation of the information submitted.
Cookies
Cookies are small bits of information a Web site sends to your computer while you are viewing that site. These pieces of information allow the Web site to remember important information that will make your use of that site more useful. SeeHearSpeakUp and other Internet companies use cookies for a variety of purposes. For instance, we use cookies to remember information you have entered while you are completing a report. Maintaining the security of your information is of great concern to us. SeeHearSpeakUp has taken security steps to protect your information. All information is submitted over a secure socket layer (SSL) using an encrypted connection to protect it.
Limitation of Liability
You expressly understand and agree that under no circumstances shall SeeHearSpeakUp or its affiliated companies be liable to any user on account of that user's use or misuse of and reliance on this service. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages. Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the service, from inability to use the service, or from the interruption, suspension, or termination of the service.
Under no circumstances shall SeeHearSpeakUp or its affiliated companies be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of god, war, governmental actions, orders of domestic or foreign courts or tribunals, or non-performance of third parties.
